Judge Issued An Initial Determination
Nanya Technology Did Not Infringe Tessera's Asserted Patents
Taoyuan, Taiwan August 31st, 2009 --Nanya Corporation (Ticker: 2408) announced today that the Administrative Law Judge (ALJ) Theodore R. Essex in the United States International Trade Commission (USITC) found no violation in an action brought by Tessera against Nanya and other DRAM manufacturers. While Judge Essex issued an Initial Determination finding Tessera's asserted patents were valid, the finding of no violation was based upon a conclusion of law that none of Nanya's accused products infringed any of the Tessera asserted patent claims. The action is Investigation No. 337-TA-630 (DRAM ITC action). Judge Essex' decision, termed an "Initial Determination," is subject to review by the full Commission. Within 120 days of the issued Initial Determination, the Commission will deliver the ITC's final determination. The respondents in the DRAM USITC action include Nanya Technology Corporation, Nanya Technology Corporation USA and other companies. Tessera's assertion of infringing its patents, U.S. Patent (U.S. No. 5,663,106 ('106), U.S. Patent No. 6,133,627 ('627), and U.S. Patent No. 5,679,977 ('977)) was rejected and no exclusion order was recommended by the judge. Nanya respects the intellectual property of other companies, and also expects other companies to respect Nanya's intellectual property.
