Taoyuan, Taiwan September 22nd, 2009 --Nanya Technology Corporation (Ticker: 2408) announced today that the Administrative Law Judge ("ALJ") Carl C. Charneski in the United States International Trade Commission ("USITC") found the patent is invalid in an action brought by LSI and Agere (collectively "LSI") against Nanya and other semiconductor manufacturers.
The action is Investigation No. 337-TA-648 ("Semiconductor ITC action"). Judge Charneski's decision, termed an "Initial Determination," is subject to review by the full Commission. Within 120 days of the issued Initial Determination, the Full Commission will issue the ITC's final determination.
The respondents in the Semiconductor ITC action include Nanya Technology Corporation, and other companies. LSI's assertion of infringing its patents, U.S. Patent (U.S. No. 5,227,335 ('335)) was rejected and no exclusion order was recommended by the judge. This is a strong evidence that Nanya respects the Intellectual Property as any other tier one companies in the world. Nanya respects the intellectual property of other companies, and also expects other companies to respect Nanya's intellectual property.
